Tesla sues Indian battery maker over trademark

Tesla Inc. has filed a lawsuit against an Indian battery manufacturer named Tesla Power India Pvt Ltd. The lawsuit alleges trademark infringement, as the Indian company has been using the trade names ‘Tesla Power’ and ‘Tesla Power USA’ to promote its products. Despite receiving a cease-and-desist notice from Tesla Inc. in April 2022, the Indian firm reportedly continued to use the brand name.

Tesla Inc. brought the case to the Delhi High Court, seeking unspecified damages and a permanent injunction to prevent the Indian company from using the Tesla brand name. The Indian company claims that its main business is making lead acid batteries. It asserts that it has no intention of manufacturing electric vehicles. They also stated that they had been operating under the ‘Tesla Power’ brand in India well before Elon Musk’s Tesla entered the market and that they have all the necessary government approvals.

The court has given Tesla Power India Pvt Ltd three weeks to submit a written response to the allegations. The court scheduled the next hearing for May 22, 2024.

This court case has sparked interest since it comes after Tesla Inc. announced significant layoffs and Elon Musk canceled a planned trip to India, where he was scheduled to meet Prime Minister Narendra Modi. Instead, Musk made a surprise visit to China, which some interpret as a snub to India.
